1. Scope

Supercar Sharing AG, in Zurich,CHE-184.767.384, operates under the protected brand Supercar Sharing® the website supercarsharing.com as well supercarsharing.ch, which allows the operator, natural persons and companies to rent, rent out, advertise or jointly purchase selected vehicles such as luxury limousines and sports cars via the co-ownership system developed by Supercar Sharing®. “Offers or vehicles” are understood to mean offers that are either advertised by members of the platform or by verified garages from the trading network or are rented out by the operator. Registered members can use the platform to rent or lease sports cars, purchase shares in exclusive vehicles for use and become co-owners of the respective vehicle.

These general terms and conditions (hereinafter & GTC) regulate the use of the Supercar Sharing AG, Badenerstrasse 549, 8048 Zurich via the website supercar sharing.ch, provided applications, content, products and services (hereinafter Services). These services include, in particular, the matching of supply and demand in the luxury car market.

Supplementary contractual provisions may apply to the use of certain services, which you will be notified of in connection with the respective services. If the general terms and conditions contradict the supplementary contractual provisions, the supplementary contractual provisions take precedence over the general terms and conditions.

The terms used in the GTC refer equally to male and female persons.

Please read these Terms and Conditions carefully before accessing or using any Supercar Sharing Services.

Dealers, tenants and co-owners can only be natural persons with full legal capacity (Minimum age 28 years) as well as legal entities.

For security reasons, we can not accept younger customers. Certain marked vehicle models are only released from a minimum age of 35 years.

Visitors, dealers and interested parties (collectively & users) declare their agreement to these General Terms and Conditions by using the website. Use is given if www.supercarsharing.ch, www.supercarsharing.com or accessed in an internet browser.

Within the framework of any contractual relationship with Supercar Sharing AG, these general terms and conditions apply.

Contractual additions to the use of special services that require registration at supercarsharing.ch become legally effective as soon as the user has successfully registered at supercarsharing.ch, applied for a vehicle share or logged in. The interested party is entitled to withdraw within 7 days from the date of ordering services, provided that the interested party has not yet used the ordered special services. Partial refunds are excluded. The withdrawal must be made in writing to the unter https://supercarsharing.ch/kontakt specified address.

The operator reserves the right to change these general terms and conditions at any time.

2. Scope of Services

Supercar Sharing AG operates the website https://supercarsharing.com, on which visitors and interested parties can discover, rent, lease and buy luxury cars (supercars). Interested parties become tenants or co-owners (co-owners) of the respective vehicles with driving licences.

2.1 Listed Vehicles for Co-Ownership

The listed vehicles in the Co-Ownership section are only accessible to members. Vehicles are entered and published either by the dealers, collectors or the operator.
The dealer or the operator is responsible for their content and the shares offered. The operator of the platform is responsible for the realization of the purchase contract. Copyright and rights of use remain with the dealer at all times, unless the operator produces his own image material for the advertised vehicles and existing vehicles of Supercar Sharing AG. The operator guarantees neither for a successful financing of the advertised vehicle nor for its realization if no purchase contract is concluded.

2.2 Listed Vehicles for Rental:

The vehicles listed in the rental area are entered, checked and published by the operator. The operator is responsible for their content and for the prices offered. Copyright and rights of use remain with the operator at all times.

3. Personal Information

The user of the supercarsharing.com website can enter personal information within his profile, which is helpful for communication with other users.

Dealers, franchisees and rental companies are asked to identify themselves with an official ID when submitting a vehicle. The operator checks the accuracy of the information provided, as far as this is possible.

If incorrect information is intentionally given in the profile or in other areas of the portal, the operator reserves the right to take legal action.

4. Data Use and Privacy

The operator observes the legal data protection regulations.

By registering at supercarsharing.ch, the user agrees to the following rules for the use of their personal information:

The operator processes the users; personal information (in particular contact details such as surname, first name, e-mail address, address, telephone number) on their own websites in order to enable supercarsharing.ch to function. This information arises from the information provided by the user and from the use of the services offered.

The user agrees that his personal data will be stored in electronic form. Users agree that the operator may share their contact information with other users to enable personal exchange of messages between users. The users may only use and edit the data in connection with the vehicle projects; unauthorized disclosure to third parties is prohibited.

The operator is also entitled to pass on the collected data to the respective e-payment service provider, insofar as this is necessary for the billing of chargeable services.

When a user accesses the services of supercarsharing.com, their data is anonymized and saved with the help of a cookie. These cookies do not contain any personal data, but are only used to maintain the functions of the website.

To avoid misuse and to prevent fraud, the operator is entitled to save the IP addresses of users of its Internet services.

The operator takes appropriate organizational and technical measures to protect against unauthorized processing of the data and uses this data exclusively for the purpose of providing its services to the user. The operator only stores data to the extent and for as long as this is necessary.

5. User Obligations

The user is solely responsible for the content of his registration and thus for the information he provides about himself and assures that the information he has provided is correct.

The user undertakes to indemnify the operator against any kind of costs, lawsuits, damages, losses or other claims that may arise from his registration or participation in supercarsharing.ch services.

The user is obliged to treat e-mails and other messages confidentially and only make them accessible to third parties with the express prior consent of the sender. This also applies in particular to names, telephone and fax numbers, address data, e-mail addresses and URLs.

Furthermore, the user undertakes not to misuse the operator's services, in particular:

Not to distribute any defamatory, offensive or otherwise unlawful material or information. In particular, this applies to pornographic, racist, hate speech or similar content.
Not to bring any data into the system that contains a computer virus (infected software) or software or other material that could damage the operator's hardware and software.
Not to publish data that is protected by copyright unless the user has the rights to use it.

6. Special obligations of providers, garages, franchisees and renter - hereinafter referred to as dealers

The dealer assures the operator that he is of legal age and agrees to identify himself with an official ID if requested.

By entering content, the dealer grants the operator a non-exclusive, worldwide, unlimited and free right to use the vehicle information. The dealer grants the operator the right to save, publish and pass on to third parties for publication the vehicle information (text, images, videos) entered by him (text, images, videos) as well as the name, brand, garage and if this disclosure of the advertising of the vehicle, the dealer or supercarsharing.ch serves. The operator is entitled to use or pass on the vehicle information in its entirety or in a modified form, alone or in combination with its own content.

7. Copyright

The operator is entitled to copyright on all self-created content on his website. Reproduction or use of content of any kind is only permitted with the written consent of the operator.

8. Liability

The operator assumes no responsibility or liability for the topicality, correctness, completeness or quality of the information provided or for any misuse of information.

Any liability for economic, physical or immaterial damage resulting from the use of supercarsharing.com is expressly excluded.

All offers are non-binding. The operator endeavors to ensure the operation of the services, but cannot guarantee uninterrupted availability. Liability for technical transmission delays or failures is excluded.

The operator reserves the right to change parts or all of the services or to temporarily or permanently discontinue publication.

The operator is not liable for the unauthorized misuse of personal user data by third parties.

The operator is not liable for hyperlinks that are outside the responsibility of supercarsharing.ch. Should the operator become aware that there is a link to a website with illegal content, he will do everything reasonable to remove the relevant link.

9. Severability

Should individual provisions of these General Terms and Conditions be or become ineffective in whole or in part, this shall not affect the validity of the remaining provisions and the validity of the rest of the contract. The parties shall replace the ineffective provision with an effective one that corresponds as closely as possible to the economic purpose of the ineffective provision. The same applies to any contractual gaps.

10. Right of Withdrawal

Please note that the right of withdrawal from rental contracts and co-owner purchase contracts is described separately in the respective section of the contract type . The revocation must be made in writing to supercarsharing.ch - Supercar Sharing AG Badenerstrasse 549, 8048 Zurich with a copy of the letter to office@supercarsharing.ch. Repayments are made by crediting the account of the share purchaser to the payment method originally chosen.

13. Jurisdiction, Applicable Law

The legal relationships between the users and the operator are exclusively subject to Swiss law. As far as the legal provisions permit, the registered office of Supercar Sharing AG - Supercarsharing.ch - in Zurich is the place of jurisdiction and place of performance. The operator reserves the right to prosecute the user at the competent court of his seat/domicile or at another competent court.

Users confirm that they have read and understood these GTC and expressly agree to the application of these GTC.
